Logjam in Courts as Govt yet to pay empanelled lawyers
[ Appu Gapak ]
ITANAGAR, May 12: The state government has not been able to clear the payments due to lawyers who appear as Public prosecutors, State Defence Council and Amicus-Curie.
With no regular Public Prosecutor, Special Public Prosecutor and Additional Public Prosecutor in the state, Presiding Officer of a court appoints from the District Panel Lawyers on case wise basis. However, the lawyers have been resenting delay in the payment of their legal fees and  Bar Associations in the districts have boycotted court appearances in protest.
“We have been conducting government trials on credit,” says advocate Tonning Pertin. He is an empanelled lawyer with East Siang district.
Pertin is also the president of East Siang District Bar Association (ESDBA) which is boycotting conduct of trials as Public prosecutor, State Defence Council and Amicus-Curie in the Court of Addl. District & Session Judge and the Chief Judicial Magistrate at Pasighat since May 2 last demanding clearance of the outstanding legal fees. The boycott on Thursday entered its 10th day.
“Many of us have not been paid for the last 3-4 years,” the ESBA president shared.
“Some amount was paid to the advocates belonging to Upper Siang district but not a single penny was paid to the lawyers working in East Siang district,” he informed adding that there has been no response till now from the government side. The association had written to the government about clearing off the pending bills last year which also went unfulfilled.
“This time we are not going back. This movement will carry on till our demand is fulfilled,” he declared.
His association blames the Principal Home Secretary for the negligence and has written to the Governor and chief minister in this regard.
“Cases will be left pending if they do not heed to our demands. They will have to then bring lawyers from outside to clear off the cases. How will they make the payments to them  when they cannot even pay us?” mocked president ESBA.
This is not the story of only East Siang lawyers. Lawyers in other districts have also been facing similar problems.
East Kameng District Bar Association, frustrated with the pending bills did not attend government legal proceedings on April 20 and 21 as a mark of protest.
“We are pursuing the matter but there has been no response from the government so far,” said president EKDBA Bimon Sonam.
Advocate Khamu Desisow of Bomdila who also holds the post of president, Additional District & Session Court Bomdila, Bar Association informed that the association is also gearing up for protest in a similar line.
“We never get the amount we are supposed to receive. Recently, we received Rs seven lakhs only but that is not enough since there are still 3-4 years pending bills to be cleared,” he shared.
“With only few empanelled lawyers, we have to attend to cases almost every day. There is no respite. And the situation becomes worse when the payment is not cleared,” said T L Sorum, president of Upper Subansiri District Bar Association.
Apart from the glitches that the judiciary is facing or is going to face with the prevailing situation, it  has been learnt that cases registered under prevention of corruption Act in the state are being kept pending for the want of special Public Prosecutor.
“The cases under this category have to be taken up with the help of special public prosecutor which is yet to be appointed by the state government,” shared Arunachal Pradesh Legal Services Member Secretary Budhi Habung.

India home to 4 most polluted cities

In an embarrassing finding, as per the report of World Health Organization (WHO),   India is home to four of the five cities in the world with the worst air pollution. The dirtiest air was recorded at Zabol in Iran, which suffers from months of dust storms in the summer. The next four are all Indian cities - Gwalior, Allahabad, Patna and Raipur. India's capital New Delhi is the ninth worst city, measured by the amount of particulate matter under 2.5 micrograms found in every cubic metre of air.

But while WHO experts acknowledge India faces a huge challenge, many countries are so bad that they have no monitoring system and cannot be included in its ranking. This finding by WHO should send alarm bell ringing in the environment ministry. Government agencies should take high pollution level as serious issue.  Often pollution as an issue does not find takers in India. Government of India will have to come out with a comprehensive long term policy to deal with this problem. Increasing air and water pollution is concern for every Indian. Major rivers are dying due to pollution. Despite the worrying sign, the WHO report also gives some hope. Delhi which was ranked the most polluted city in the previous finding has come down to 9th this time around.  WHO report stated that various measures taken by government have helped to improve the air quality in Delhi. This should serve as an inspiration to rest of the country. Both central and state government will have to join hand together in the fight against pollution.

Rhinos and poachers

Dear Editor,

The NE Indian state of Assam is hailed globally as the last and largest concentration of endangered one-horned Indian rhinoceros. However, in spite of successful conservation and increasing number of the species across the state, highly organized poaching units operational in the region are causing regular deaths of this majestic mammal in Assam for extracting rhino horns. The rhino horns like elephant tusks and bear or tiger body parts bring huge financial returns in the illegal international market of wildlife products operating in China and SE Asia. We need to explore seriously why the conservation efforts are failing and poaching is continuing indiscriminately in spite of the serious efforts of the local administration. One of the point of failures in the full proof conservation efforts are not including people as conservation stakeholders inhabiting Kaziranga, Manas, Orang and other wildlife parks/sanctuaries and adjoining regions in an comprehensive conservation effort. The rural populations in these pockets being extremely poor are highly vulnerable to exploitation by the organized poaching units for providing them with food and shelter hiding them from security agencies as well as serving as forest guides, animal trackers, carriers or transporters in exchange for cash. They also provide intelligence information to the poaching units helping them to operate efficiently in the region.

Recently, local forest staffs have also been identified to be involved directly or indirectly in the poaching and wildlife trafficking. This is a huge challenge as the poachers have infiltrated deep inside the administration providing them covert support to operate in the region in exchange for money. Unless the economic empowerment of these extremely poor rural communities is made a priority by the local administration, rhino poaching could not be prevented.  Assam government has always worked diligently in downplaying the gravity of the situation; but serious investigation, conviction and punishment of staff members involved in poaching and trafficking activities at high level has been carefully avoided. A serious networking with the population settled in and around the wildlife habitats need to be established to break the poaching network. Poorly armed guards could not fight against poachers with advanced weapons and communication system and their connectivity across porous international borders. Until the people working within the system are secretly helping the poachers are removed or punished; rhino conservation will continue to be a significant challenge in Assam.

Furthermore, rhino population needs to be decentralized from their strong concentration in Assam to suitable habitats in adjoining Arunachal Pradesh, Assam, Bihar and Uttar Pradesh. On one hand this will help the species to thrive in newer and bigger habitats along with that in Assam; and will also make the poaching units disorganized as their targets would be spread across vast territories. The SAARC and ASEAN member nations need to include a common agreement for introducing Joint Conservation Initiative (JCI) across all the member nations to prevent poaching, prevent wildlife trade,  trafficking and underground wildlife markets operating in the region. Such approach could be a big boost for conservation across entire South and SE Asia, protection of animal migration corridors, strict regulation on poacher and wildlife traffickers, captive breeding of endangered species and their introduction to the wild, artificial breeding of rare wildlife and forest plants, exchange of expertise and useful conservation techniques and knowledge could thus be facilitated among the participating nations.

Reschedule exam dates

Dear Editor,

It's my earnest and sincere request to the Registrar and Controller of Examinations, Rajiv Gandhi University (RGU) to adjust/reschedule the date of examination for Political Science Subject as it is coinciding with the entrance examination of Jawaharlal Nehru University (JNU), New Delhi for political sciences in Masters Programme (MA Political science) which is also scheduled on the same date, i.e., 16/05/2016.

As JNU is considered to be one of the best universities, it would be a great opportunity for exposure and future scopes if one gets a chance to study there but in such cases of examination dates coinciding, the very chance to try for it does not exist.

Hence it is a sincere request to the RGU authorities to look into the matter and reschedule the examination date for the above mentioned subject.

Yours
